This terms of use (“Terms of Use”) govern your use of our website https://www.kplor.com/ (“Platform”) and product offered through the Platform (hereinafter collectively referred to as “Offerings”) which are owned, controlled and operated by Mindshift Labs Private Limited ("Company" or “Kplor”), a company incorporated under the laws of India, having its principal place of business at #413, 14th C Cross, Pai Layout, Bengaluru - 560016, operating under the brand name Kplor.

These Terms of Use will be treated as an ‘electronic record’ as defined under the Information Technology Act, 2000 and the rules made thereunder (as modified from time to time). Further, these Terms of Use are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. You hereby explicitly acknowledge that this electronic record is generated by a computer system and does not require any physical or digital signatures.

For the purposes of these Terms of Use, “we”, “our” and “us” shall mean the Company and “you” and “your”, shall mean a user of the Offerings, whether registered or not (“User”).

PERMITTED USERS

  • You shall not access and/or use the Offerings if you are not competent to contract under the applicable laws, rules and regulations.

  • People below the age of 18 years should use the service under the supervision of parents or guardians.

ACCESS

Kplor gives you the permission to use the platform, provided that,

  1. you will not copy or distribute, any part of the Offerings in any medium or in any manner whatsoever

  2. you will not alter or modify any part of the Offerings

  3. You must provide correct and accurate information in your login info

  4. You cannot transfer your access to another person or entity

  5. You agree not to

  • Use the services for any illegal activities or unauthorized purposes

  • Attempt to access systems or data not intended for you

  • Interfere with the operation of security of service

  1. Temporary outage may occur due to maintenance or technical issues

  2. You are responsible for making all arrangements necessary for you to have access to the Offerings i.e., have the necessary equipment, software, and internet connection.

  3. We have the right to disable any User identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use.

OWNERSHIP OF THE OFFERINGS

  • All content, features, and design elements made available through our service are the exclusive property of Kplor.

  • You cannot use our trademarks, logos, or branding without written permission.

USE OF THE OFFERINGS

  • The service is currently provided as a beta version which means that it is under active development and is still being tested. Features may change continuously and may vary.

  • Any feedback regarding bugs or other issues is welcome and can help us a great deal to improve the product.

UNAUTHORISED USE

This platform and its services are solely for the purpose of education. Users are expected to engage respectfully with the tutor and stay within the scope of academic support.

As a User, you agree not to:

  • Ask the tutor questions that are not related to the curriculum or subject matter

  • Attempt to initiate discussions of a violent, sexually explicit(NSFW), abusive, or otherwise inappropriate nature

  • remove, from the Offerings, any logo, copyright or proprietary notices, legends, symbols, labels, watermarks, signatures access or using the Offerings in a manner that violates any applicable laws, regulations, or third-party rights;

  • attempt to gain unauthorized access to other user accounts, systems, or networks associated with the Offerings;

  • interfere with or disrupt the normal operation of the Offerings, its servers, or networks.

  • engage in any activity that could harm, disable, overburden, or impair the functionality or security of the Offerings; or any other like marks affixed to or embedded in the Offerings

Any violation of these guidelines will result in immediate revocation of access to the platform. We reserve the right to investigate and take appropriate action against misuse of the platform.

USER CONTENT

  • While using the product, you will be giving inputs like image, video, etc. You represent and warrant that you have all necessary rights and authority to provide the Input and that it does not violate the intellectual property rights or other rights of any third party.

  • Once the Product receives your Inputs, it will generate content, results, or other output, in the form of text, voice etc. ("Output"), using certain algorithms and processes (both Input and Output shall be collectively referred to as the “Content”).

Access to and use of the Offerings is also subject to the Company’s privacy policy, available at https://kplor.com/privacy-policy

RIGHTS RESERVED BY THE COMPANY

The Company has the right to investigate and prosecute any violations of the Terms of Use and the Privacy Policy and the conditions therein to the fullest extent of the law and may involve and cooperate with law enforcement authorities in prosecuting Users who violate these terms and conditions.

INDEMNITY

You agree to indemnify, defend and hold harmless the Company and all other persons related to, associated or connected with the Company, from and against any and all liabilities, losses, damages, costs and expenses, including without limitation, legal fees, incurred by the Company or such other person in connection with any claim, demand or other action arising out of, related to, or connected with your use of the Offerings, or your breach of these Terms of Use. This indemnification obligation will survive these Terms of Use.

LIMITATION OF LIABILITY

  • access to these offerings, including features of the product are available to use as a matter of convenience. the company expressly disclaims any claim or liability arising out of the content. you agree and acknowledge that you shall be solely responsible for your conduct and that the company reserves the right to terminate your right to access and avail of the offerings immediately, without prejudice to initiating proceedings under the relevant penal provisions under the Indian information technology act, 2000 or any other allied laws enacted by the government of India or any other statutory, legislative or regulatory authority that may have jurisdiction or be authorized to do so in this regard from time to time.

  • in no event shall the company be liable for any direct, indirect, punitive, incidental, special or consequential damages or for any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the access, use or performance of the offerings, its features and facilities or for interrupted communications, delay, etc., or inability to use the offerings, the provision of or failure to provide the features and facilities, or for any information, software, products, services and related graphics obtained through the product, or any other site, whether based on contract, tort, negligence, strict liability or otherwise, even if the company had been advised of the possibility of damages. this clause shall survive in perpetuity.

DISCLAIMER

  • The AI Tutor is provided only for educational purposes and is designed to support learning by offering explanations. While we strive to ensure the information delivered is accurate and helpful, the AI Tutor is an automated system and may occasionally produce incomplete, outdated, or incorrect responses.

  • The AI Tutor is not a replacement for human educators, just a tool to support and enhance the learning experience.

  • The Company shall not be liable for any loss or damage, including but not limited to indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Output. You hereby waive any claim against the Company for any damages, losses, or liabilities arising out of or in connection with the use of the Output, including but not limited to those resulting from reliance on the Output for making critical decisions.

  • As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

OUTPUT RELATED DISCLAIMERS

The Output generated by the Product is based on algorithms and automated processes and is therefore intended for informational purposes only and does not constitute professional advice.
